Terms and refund policy

DRAFT. These terms are a plain-language draft that has not yet been reviewed by a lawyer. They are not legal advice and will be reviewed and may change before launch.

Effective date: [Effective date]

1. About these terms

somniov ("I", "me") is a one-person 3D printing service based in Joliet, Illinois. These terms apply when you send a quote request or place an order. By sending a request you agree to them. You must be 18 or older to use this service. These terms are governed by Illinois law. Customer service: business@somniov.com.

2. Your files and your rights to them

  • You confirm that you own every file (and any logo or artwork in it) that you send, or that you have the rights, including any license terms such as "non-commercial" clauses, to have it printed for you.
  • You give me permission to use your files only to quote and print that order. I don't claim ownership of your designs, and I don't reuse, sell or share them.
  • You agree to indemnify and hold me harmless from claims arising from your files or from your use of the printed parts, including claims that they infringe someone else's rights.

3. Copyright and trademark complaints

If you believe a file sent to me infringes your copyright or trademark, email business@somniov.com with your contact details, the work you own, and why you believe it was copied. I'll stop work on the job while I look into it.

4. I can say no

I can refuse or cancel any job for any reason, including suspected infringement, regulated items, safety concerns, or a part I don't think will print well. If you've already paid, I refund you in full.

5. What I won't print (no exceptions)

  • Firearms, and any firearm part, frame or receiver (finished or unfinished), or accessory; magazines; suppressors, silencers or "solvent trap" kits; conversion devices; realistic replica guns.
  • Other weapons, such as knives, knuckles or batons.
  • Anything illegal to make or own in Illinois or where it's being shipped.
  • Counterfeit items, or items using someone else's trademarks or characters without a license.
  • Harassing, hateful or obscene items.
  • 3D scans of real people's faces or bodies.

Illinois law (720 ILCS 5/24-5.1, added by Public Act 102-0889) bans selling or transferring unserialized firearms and unfinished frames or receivers, including 3D-printed ones. PayPal's Acceptable Use Policy also prohibits transactions for ammunition, firearms, certain firearm parts or accessories, and certain regulated weapons or knives. So I refuse all weapon-related jobs.

6. Parts where failure could hurt someone

I don't take jobs for safety-critical uses: parts that hold weight over people, climbing, lifting or restraint gear, vehicle safety or brake parts, medical devices, food or drink contact, or toys for young children. If I learn a part is meant for one of these uses, I'll decline or cancel it with a full refund.

7. Quotes

  • Quotes are free and valid for 14 days.
  • A quote is based on the files and details you sent. Changed files mean a new quote.
  • Every quote states the price, shipping (if any), and a ship-by date (or ready-for-pickup date).

8. Payment

  • Nothing is paid on this website. When you approve a quote, I send a PayPal invoice.
  • No work or printing starts until the invoice is paid in full, or, if your quote says so, until a 50% deposit is paid, with the balance due before shipping or pickup.
  • A deposit becomes non-refundable once printing starts, except when I cancel, can't deliver, or made an error (see the refund policy).
  • Illinois sales tax is added where required. Shipping is listed as its own line. The item price is the same whether you pick up or have it shipped.

9. Ship-by dates and delays

I ship (or have your order ready for pickup) by the date in your quote. If I can't, I'll email you before that date with a new date and the choice to cancel for a full refund of what you paid. If a quote ever doesn't state a date, the ship-by date is 30 days after your payment.

10. Shipping and pickup

  • I ship to US addresses only for now (email me first if you need something sent elsewhere). I ship only to the shipping address in your PayPal payment, with tracking. Please check it before you pay. To change the address after paying, I cancel and refund the invoice and send a new one.
  • If a package is lost in transit, I'll work with the carrier, then reprint or refund once it's confirmed lost.
  • Local pickup in Joliet, Illinois is arranged by email. I hand orders only to the person named on the order and may ask you to sign or photograph a pickup receipt.

11. Printing tolerances

Prints are made with FDM (filament) printing. Expect visible layer lines, small surface marks, and some variation in dimensions, strength, finish and color from the file and from photos. I don't guarantee that a part will fit or work for a particular purpose unless we agree to that in writing. If fit matters, tell me in your request; testing the part is your responsibility.

12. Refund policy

Every order is custom-made from your files, so orders are non-refundable except:

  • Defects or errors I caused, a print that doesn't match what we agreed, or damage in shipping: email me within 14 days of receiving it, with photos and your reference number, and I'll reprint it or refund you (my choice).
  • If I refuse or cancel a job, you get a full refund.
  • If I'll miss the ship-by date and you choose to cancel, you get a full refund.

Not covered: problems caused by the files themselves (for example wrong scale, walls too thin, or parts that don't fit because of the design), dimensions you supplied, or a change of mind after printing has started. I'll point out obvious file problems before quoting when I spot them. To ask for a refund or reprint, email business@somniov.com.

13. Limit of liability

To the extent the law allows, my total liability for any order is limited to the amount you paid for that order, and I'm not liable for indirect or consequential losses. Nothing in these terms limits liability that the law doesn't allow to be limited.

14. Deleting your files

I delete your uploaded files 30 days after your order is delivered or your quote expires or is declined, and sooner if you ask. The site also deletes stored uploads automatically 60 days after upload. Keep your own copy. See the privacy policy.

15. Changes and contact

I may update these terms; the effective date above shows the latest version, and the terms in place when you paid apply to your order. Questions or problems with an order: business@somniov.com.
